Smart Junior Plan 499

The Smart Postpaid Junior Plan (“Junior Plan” or “Service”) is a postpaid supplementary mobile subscription offered by Smart Communications, Inc. (“Smart”), designed for young dependents (“User”), under the management and responsibility of their parent or guardian (“Primary Account Holder”). By subscribing to the Junior Plan, the Primary Account Holder acknowledges that they have read, understood, and agree to be bound by these Terms of Use ("Terms"). These Terms supplement the Primary Account Holder’s Smart Postpaid Plan’s Terms & Conditions, Terms of Use, and Privacy Policy available at https://smart.com.ph/Corporate/terms and are deemed incorporated into these Terms. If there is any inconsistency between the terms and conditions listed above and these Terms, as to the Junior Plan, these Terms will prevail. The Primary Account Holder acknowledges and agrees that the Smart Postpaid Plan’s Terms and Conditions and all provisions thereof not otherwise inconsistent with this Terms shall likewise apply to the Junior Plan and shall remain valid, subsisting, and binding on Primary Account Holder.



  1. Definition

    Unless otherwise specifically defined herein or the context otherwise requires, capitalized terms used in this Terms shall have the same meanings as indicated in the Smart Postpaid Plan’s Terms and Conditions.


  2. Description of Service

    The Junior Plan is an add-on subscription available exclusively to Primary Account Holders of the Eligible Smart Postpaid Plans, as herein defined. It offers postpaid mobile services, including data, unlimited mobile calls, unlimited texts, and unlimited access to select applications for its User. The User refers to any young dependent who uses the Junior Plan and relies on the Primary Account Holder for the enrollment and management of their mobile service subscription. The Primary Account Holder retains full responsibility for managing the Junior Plan, in compliance with these Terms.


  3. Activation

    a) Activation Requirements: The Primary Account Holder must provide all required documentation and complete the application and activation process on authorized sales channels.
    b) User Eligibility: The following requirements must be complied with before a Primary Account Holder may avail of a Junior Plan for a User:
    i. User must be a dependent of the Primary Account Holder; and
    ii. User must either be:
    a. A student up to college undergraduate level; or
    b. Aged 7-25 years old.
    The Primary Account Holder must present or submit proof of identification for the User during the Junior Plan application process. Acceptable documents include a valid student ID or other valid official identification that verifies the User’s identity.

    c) Primary Account Holder Conditions: The Junior Plan must be linked to an active Smart Postpaid Signature Plan 999 or higher held by the Primary Account Holder (the “Eligible Postpaid Plan”). To retain the active status of the Junior Plan, the Primary Account will be subject to the following conditions from the date of Junior Plan activation:

    i. The account must remain with Smart and not be switched to another network;
    ii. The account must retain its Eligible Postpaid Plan status and not be downgraded to ineligible postpaid plans nor converted to prepaid; and
    iii. The account must remain active and connected;
    If the Primary Account does not meet all of the above conditions, Smart reserves the right to disconnect the linked Junior Plan.


  4. Junior Plan Features

    a) Inclusions: The Junior Plan will have the following inclusions:

    i. Data Allocation: 10GB of all-access data per month with rollover of unused data to the next billing cycle.
    ii. Unlimited Services: Unlimited Mobile Calls and Texts to all local mobile networks in the Philippines.
    iii. Unlimited App Access: Unlimited data access to select mobile applications subject to a Fair Use Policy: regular speed at up to 2 GB data usage per day per mobile application, before data speed is throttled to 2 Mbps after 2 GB capping. Smart reserves the right to change, update, add, or modify any of the mobile applications included in the unlimited data plan access (please refer to https://smart.com.ph/JuniorPlan to view the updated list) at any time without prior notice.

    b) Contract Term: The Junior Plan has a minimum subscription term of three (3) months.

    c) Non-Transferable: The Junior Plan is non-transferable between existing Primary Accounts.


  5. Usage

    a) Usage Limitations: The following services are not applicable for the Junior Plan:
    i. Pasaload, Pasadata, Pasapoints and similar transfer services.
    ii. Data sharing for the Unlimited App Access inclusion.

    b) Usage Responsibility: All usage under the Junior Plan is the responsibility of the Primary Account Holder. The Primary Account Holder shall be held liable for any Fraudulent, Unauthorized Activities, and/or Illegal Activities by the User.

    c) Account Management: Only the Primary Account Holder may initiate aftersales transactions for the Junior Plan, such as plan upgrade, disconnection, or change of Mobile Identification Number (“Change MIN”), among others.


  6. Billing and Payment

    a) Unified Billing:
    i. All charges related to the Junior Plan will appear on the Primary Account Holder’s Statement of Account (“SOA”).
    ii. All charges related to the Junior Plan, including monthly fees, overages, and penalties, will be billed to the Primary Account Holder’s account.

    b) Shared Credit Limit: The Junior Plan will share the credit limit of the Primary Account. All charges incurred under the Junior Plan, including usage on top of the allocated inclusions, will be applied against the Primary Account's credit limit. The Primary Account Holder is responsible for ensuring that the shared credit limit is sufficient to cover both their own usage and that of the User. Any adjustments to the credit limit must be requested by the Primary Account Holder through Smart's customer service channels and subject to existing credit parameters.

    c) Default Policy: Late or missed payments on the Primary Account may result in temporary suspension or termination of the Junior Plan. Conversely, late or missed payments on the Junior Plan may also result in temporary suspension or termination of the Primary Account.


  7. Plan Modification Policies

    a) Plan Renewal: The Primary Account Holder may choose to convert the Junior Plan to a regular Smart Postpaid Plan by re-contracting the line to any available postpaid plan offer, subject to applicable business rules, credit parameters, and approval of Smart.

    b) Plan Ownership Transfer: The Primary Account Holder may transfer account ownership of the Junior Plan to the User who has come of legal age, subject to applicable business rules, credit parameters, and approval by Smart.

    c) Validity Period and Continuation Policy: The Junior Plan is valid for 10 years from the date of activation. After 10 years of continuous use, the Primary Account Holder may:
    i. Choose to continue the Junior Plan by paying an additional fee of Two Hundred Pesos (P200.00) per month on top of the Junior Plan’s current Monthly Service Fee (MSF); or
    ii. Convert the Junior Plan to an available Smart Postpaid Plan offer via plan contract renewal.

    Notifications regarding the plan’s 10-year validity will be sent to the Primary Account Holder before the 10-year term ends.


  8. Termination and Disconnection

    a) Disconnection.
    i. If the Primary Account is permanently disconnected (voluntarily or involuntarily), the Junior Plan will also be permanently disconnected.
    ii. If the Primary Account is temporarily disconnected (voluntarily or involuntarily), the Junior Plan will also be disconnected following the status of the Primary Account.
    iii. If the Junior Plan is involuntarily disconnected (due to late or missed payments), the Primary Account will also be disconnected.
    iv. If the Junior Plan is voluntarily disconnected, by request of the Primary Account Holder, the Primary Account will be unaffected.

    b) Termination Charges. Upon disconnection, any and all charges incurred and all applicable penalties and pre-termination charges for the Junior Plan will be billed to the Primary Account.


  9. Data Privacy and Consent

    a) Compliance with Data Privacy Laws: Smart shall adhere to the Data Privacy Act of 2012, its implementing rules and regulations, and all other applicable laws and government issuances in the Philippines, both current and future, pertaining to privacy and the protection of personal information (“Privacy Laws”). All personal data collected by Smart in connection with this application shall be processed pursuant to Privacy Laws. The User’s identification documents will only be presented or submitted for application verification and audit purposes. The documents will only be retained by Smart within 30 days from submission. After which, the documents will be deleted securely.

    b) Primary Account Holder’s Consent: By subscribing to the Junior Plan, the Primary Account Holder consents to Smart’s processing of User’s personal data, for purposes and in a manner strictly limited to what is necessary for the following:
    i. Perform our obligations under contract to deliver the Service;
    ii. Process your personal data based on our legitimate interest to function effectively as a business, except when your fundamental rights and freedoms override our interests. This includes providing after sales customer care, improvement of business, operations, products and services, sending you information about our products and services, and managing the security of our business operations; and
    iii. to comply with legal and regulatory requirements.

  10. Amendment to Terms

    Smart reserves the right to modify or revise these Terms at any time without prior notice. By continuing to use the Junior Plan after any changes to these Terms, the Primary Account Holder agrees to be bound by the revised Terms.
