Welcome to the SMART Multi SIM App! This mobile application (“SMART Multi SIM App” or "App") allows you to manage multiple Embedded Subscriber Identity Module (“eSIM”) on your single SIM slot and non-eSIM capable device. This service is provided and managed by Smart Communications, Inc. ("SMART," "We," or "Us").
BY USING THE SMART MULTI SIM APP AND ITS FUNCTIONALITIES, INCLUDING SIM REGISTRATION THROUGH THE APP, YOU AGREE TO THESE TERMS AND CONDITIONS GOVERNING THE USE OF THE SMART MULTI SIM APP, AS WELL AS THE SIM REGISTRATION TERMS AND CONDITIONS. IF WE MAKE CHANGES TO THESE TERMS AND CONDITIONS THAT MATERIALLY AFFECT YOUR RIGHTS AND OBLIGATIONS IN USING THE SMART MULTI SIM APP, WE WILL NOTIFY YOU. YOUR CONTINUED USE OF THE APP AFTER SUCH CHANGES ARE POSTED WILL BE CONSIDERED AS YOUR ACCEPTANCE OF THE UPDATED TERMS AND CONDITIONS.

DESCRIPTION
The SMART Multi SIM App makes eSIMs accessible to everyone. This App allows you to use Android handsets with SIM slots, running on Android version 9 and up, to scan eSIM QR codes, download and activate up to five (5) eSIM profiles, and easily manage them by switching, renaming, or deleting. The activation of local and international eSIMs are supported, but it is not guaranteed.

COMPATIBILITY AND AVAILABILITY
Compatibility checking is necessary to determine whether your handset supports the SMART Multi SIM App.
2.1. The App is available for download from the Google Play Store.
2.2. It is compatible only with Android handsets with SIM slots and running on Android version 9 and up.
2.3. It will function only with a SMART or TNT Multi SIM (collectively herein as the “SMART Multi SIM”).
2.4. While the App is developed for supported devices, compatibility may vary due to differences in device specifications, operating system updates, and other factors. You are responsible for ensuring that your device meets the necessary system requirements before purchasing a SMART Multi SIM.

SMART Multi SIM PROFILES
3.1. SMART Multi SIM is a physical SIM with the capability to store and manage up to five (5) eSIM profiles using the SMART Multi SIM App. It comes with a default SIM profile, which can be either SMART Prepaid or TNT. This default profile is permanently stored on the SIM and cannot be deleted from the App or the eSIM itself (the “Default SIM Profile” or “Default Profile”).
The SMART Multi SIM can function without the App and will automatically connect to the SMART network once inserted into a device. You can store multiple eSIM profiles on the SMART Multi SIM, but only one SIM profile can be active at a time.
3.2. eSIM Profiles are stored in the SMART Multi SIM. These are digital profiles that you can add, activate, and delete, allowing you to switch between different mobile network providers.
You can activate eSIM profiles on the SMART Multi SIM App using any of the following options:
3.2.1. Scanning an eSIM QR code.
3.2.2. Uploading a photo of the eSIM QR code from your device gallery.
3.2.3. Activation code provided by the eSIM provider.

SIM REGISTRATION
THE SMART MULTI SIM AND THE EACH ADDITIONAL ESIM MUST BE REGISTERED IN ACCORDANCE WITH THE APPLICABLE SIM REGISTRATION LAWS AND EACH ESIM SHALL BE REGISTERED UNDER YOUR NAME AND SHALL BE UNDER A SINGLE OWNER’S NAME ONLY.
4.1. SMART SIMs: The SMART Multi SIM’s Default Profile and the additional SMART/TNT eSIM profiles may be registered through the SMART’s designated online portal (“SIM Registration Portal”) accessible via the following link: https://smart.com.ph/simreg and will be governed by the Republic Act No. 11934 otherwise known as the "Subscriber Identity Module 'SIM' Registration Act" and its Implementing Rules and Regulations set out in NTC Memorandum Circular No. 001-12-2022 (hereafter, the "SIM Registration Act") as well as the Terms and Conditions for the SIM Registration (the “SIM Registration Terms and Conditions”). The link to the SIM Registration Portal is also available in the SMART Multi SIM App and/or the welcome message from SMART.
4.2. Local eSIMs: By using the SMART Multi SIM and all associated local eSIMs, you must strictly comply with the SIM Registration Act. SMART shall not be responsible or liable for any of your violations under the said law.
4.3. International eSIMs: SIM registration requirements vary by country. You are responsible for complying with the SIM registration laws applicable to your eSIM provider. SMART shall not be liable for any of your violations under the said laws.

USE OF THE APP
When Internet Connection is Required. Access to a reliable internet connection is necessary to complete the transactions within the SMART Multi SIM App, as follows:
5.1. Downloading of the SMART Multi SIM App. Ensure that your handset is compatible with the App before using the SMART Multi SIM. You must be of legal age to download and use the SMART Multi SIM App. You are responsible for any data charges incurred while downloading or using the App. By using the SMART Multi SIM App, you agree to use it only for lawful purposes and in compliance with these Terms and Conditions. Any unauthorized modification or distribution of the SMART Multi SIM App is strictly prohibited.
5.2. Activation of eSIM Profile. An eSIM profile may be activated, either by:
5.2.1. Scanning or Uploading of eSIM QR Code. You should only scan or upload valid eSIM QR codes that you availed of from SMART, TNT or from any local and international eSIM providers. The App supports scanning or uploading of local and international eSIM QR codes. You are solely responsible for ensuring the accuracy and validity of any scanned or uploaded QR code. The SMART Multi SIM App assumes no responsibility for any and all errors or issues resulting from scanning or uploading of invalid, corrupted or unsupported QR codes. You must report the invalid, corrupted or unsupported QR code with the sales channel or store where you availed of such QR code. SMART reserves the right to suspend or restrict scanning of eSIM QR code for any reason, without any liability.
5.2.2. Manual Activation Code. If eSIM QR code scanning is unavailable, users can manually enter the manual activation code provided by SMART.
For local and international eSIMs, the activation code is provided by the respective mobile network provider upon eSIM purchase and is usually sent via email, SMS, or through the mobile network provider’s app or website. Any invalid, corrupted or unsupported manual activation code must be reported to the sales channel or store where the eSIM was purchased.
SMART shall not be responsible or liable for any manual activation codes provided by your local and international eSIM providers.
Successful eSIM activation using the SMART Multi SIM App depends on several factors, including, but not limited to, validity of eSIM QR code or manual activation code, and network availability. You are responsible for following all the activation instructions provided within the SMART Multi SIM App. The SMART Multi SIM App does not guarantee successful activation in all cases.
5.3. Deletion of eSIM Profiles. The Default SIM Profile cannot be deleted in the SMART Multi SIM App or on the SMART Multi SIM. However, you can delete any of the additional eSIM profiles through the SMART Multi SIM App. Make sure to turn off the eSIM profile or set it to inactive status before deletion. Deleting an eSIM profile may result in the loss of the associated data. SMART shall not be responsible for any data loss resulting from the deletion of an eSIM profile. Deleted eSIM profile can no longer be used unless reactivated in accordance with Section 5.4.
5.4. Reactivation of eSIM Profile.
5.4.1. SMART eSIMs. You can keep the SMART eSIM QR code or activation code for future re-activation. You must ensure that your eSIM maintains a sufficient balance and an active wallet. Please refer to either the SMART Prepaid GSM Service Terms and Conditions (https://smart.com.ph/Corporate/terms/smart-prepaid) or the TNT Prepaid Terms and Conditions (https://tntph.com/terms-and-conditions) (each, a “Prepaid Service Terms and Conditions”) for the complete guidelines on permanent disconnection.
5.4.2. Local and International eSIMs. You need to check the eSIM provider's re-use policy to determine whether their QR code or manual activation code may be used for re-activation. SMART shall not be responsible or liable for any unsuccessful re-activation of an eSIM profile.
When Internet Connection is NOT Required. The following transactions within the SMART Multi SIM App may be completed even if your device is not connected to the internet:
5.5. Toggling On and Off of a SIM Profile. This will allow you to toggle ON or OFF a specific SIM profile through the SMART Multi SIM App. When a SIM profile is toggled ON, it becomes active and redirects you to your device's SIM management settings, allowing you to set the activated SIM as the default for calls, SMS, and data if supported by your device. When toggled OFF, the profile is temporarily deactivated, restricting its use. Toggling it ON through the device settings will not activate the SIM requiring you to activate the SIM through SMART Multi SIM App. You must always use the SMART Multi SIM App to manage SIM profiles.
If a SIM profile is disabled in the device’s SIM management settings, the SMART Multi SIM App cannot detect the SIM, and it will not connect to the network. You must use the SMART Multi SIM App to manage your SIM profiles.
5.6. Switching SIM Profiles via the SMART Multi SIM App. This function applies when the SMART Multi SIM stores multiple SIM profiles. Using the SMART Multi SIM App, you can manually switch between SIM profiles with the corresponding toggle ON/OFF buttons. You can easily select your preferred SIM profile, such as switching between local and international SIM profiles or personal and business numbers, if applicable.
When switching SIM profiles, you will always be redirected to your device's SIM management settings to assign which profile will be used for calls, SMS, and data, if any of these are supported by your device.
5.7. Switching from SIM1 to SIM2 and vice versa via the SMART Multi SIM App. The SMART Multi SIM App allows you to easily switch between SIM 1 and SIM 2 when this feature is supported by your device. This requires two (2) SMART Multi SIMs inserted into the device’s dual SIM tray. Each SMART Multi SIM can store up to five (5) eSIM profiles.
When switching SIM slots through the App, you will always be redirected to the device's SIM management settings, prompting you to select which profile will be used for calls, SMS, and data, if any of these are supported by your device.
5.8. Renaming of eSIM Profile. Only the Profile Name can be renamed, subject to the following rules:
5.8.1. Minimum and maximum number of characters is 0-64 to ensure readability and proper display across devices.
5.8.2. Only letters (A-Z, a-z), numbers (0-9).
5.8.3. Symbols (@, #, $, etc) are supported.
5.8.4. The new name must be different from the existing eSIM profile names on the device to avoid confusion.
5.8.5. The name must not contain profanity, offensive language, or misleading terms (e.g., "Emergency", "No SIM", "Invalid").
5.8.6. The name must not impersonate official carrier names unless assigned by the carrier.
5.8.7. The name should be easy to recognize and should not consist solely of random characters (e.g., "abc123xyz" is discouraged).

LOST OR STOLEN HANDSET WITH SMART MULTI SIM APP & SIM
Lost or stolen physical Multi SIM card and all of the associated SMART/TNT eSIMs therein must be reported to SMART immediately by visiting any of the SMART Retail Stores or by contacting SMART. This prevents unauthorized use of the aforementioned SIMs and any potential charges therein in accordance with the applicable Prepaid Service Terms and Conditions.
For local and international eSIMs, you must coordinate immediately with your eSIM provider. SMART shall not be responsible or liable for any loss or damage which may be incurred as a result.

SMART MULTI SIM AND ESIM QR CODE / MANUAL ACTIVATION CODE VALIDITY
Validity of the SMART Multi SIM, SMART/TNT eSIM and the corresponding eSIM QR codes or manual activation codes shall be in accordance with the applicable Prepaid Service Terms and Conditions.
For local and international eSIMs, you must follow the terms and conditions regarding its validity, as provided by the seller or the eSIM provider.

TRANSFERRING SMART MULTI SIM TO ANOTHER HANDSET
8.1. Without a SMART Multi SIM App. When the SMART Multi SIM is inserted into another handset without the SMART Multi SIM App, the SMART Multi SIM will work as a regular SIM. The last enabled SIM profile, whether it be the Default SIM Profile or one of the additional eSIMs, will be the active profile. If you need to use the full functionality of the SMART Multi-SIM, such as but not limited to, switching of the SIM profiles, you must download the SMART Multi SIM App from the Google Play Store and install it on the handset you are using.
8.2. With SMART Multi SIM App. When the SMART Multi SIM is inserted into another handset with the SMART Multi SIM App installed, you should ignore or dismiss the prompt to download and install the App. If the 'OK' option was selected un-intentionally, redownloading will only update the SMART Multi SIM App.

NO SIGN IN / LOG IN IS REQUIRED
The SMART Multi SIM App does not require you to sign in. All functionalities are accessible without the need for an account or login credentials. You are responsible for any unauthorized use of the SMART Multi SIM App.

FRAUD & ABUSE OF SMART MULTI SIM APP
SMART reserves the right to disconnect the service and/or refuse to reconnect the SMART Multi SIM App in the event that you or any person/s concerned is found to have used it for any of the following unlawful, fraudulent, illicit or abusive purpose, including, but not limited to:
10.1. Utilization of the service in bypassing or in activities that tend to bypass the SMART network, billing and/or traffic routing;
10.2. Use of the service in prohibited services like callback, dial back, unauthorized audio text, international and national simple resale (ISR/NISR), international revenue share fraud (IRSF), premium rate service (PRS) fraud, internet fraud, hacking, SMS spamming, SMS flooding, SMS hoax, and other similar services;
10.3. Tampering, altering, modification, or unauthorized programming of the SIM Card or its digital reference; or
10.4. Activation of any eSIM profile owned or registered under the name of a third person without complying with the registration requirements in accordance with the SIM Registration Act.
Furthermore, SMART reserves the right to file appropriate legal action against you or any person/s concerned. You or any person/s concerned shall likewise be liable to SMART for any and all damages resulting from any of the above unauthorized and illegal activities.
In the event that a non-SMART eSIM within the Smart Multi SIM App is used for any unlawful, fraudulent, illicit, or abusive activities, SMART shall not be liable for any revenue leakages incurred by third-party mobile network providers. Furthermore, SMART assumes no responsibility for settling any resulting damages or associated costs.

DATA USAGE
The SMART Multi SIM App will use device information (e.g., Android software version), Mobile Station International Subscriber Directory Number (MSISDN), and Embedded SIM Identifier (EID) to function.
EID - is a unique 32-character alphanumeric string, and its function is to identify whether the SIM card accessing the SMART Multi SIM App is a SMART Multi SIM.
11.1. EID File Requirement - For the solution to function, the SMART Multi SIM requires the EID file, which contains the EID, International Mobile Subscriber Identity (IMSI), Integrated Circuit Card Identifier (ICCID), and MSISDN. This file is securely transferred via a secure SFTP exchange server, and only the SMART Multi SIM server can decrypt and read these files.
11.2. Device Compatibility Check - The SMART Multi SIM App uses the Android software version information to validate if your device is compatible for the App installation.
11.3. EID File - The EID file stored on the SMART Multi SIM server is used solely to verify that you are using the correct SIM card for accessing the SMART Multi SIM App and to display the Mobile Identification Number (MIN) of the SIM profile in the App.

IN APP PURCHASES
SMART shall not be responsible for damages, delays, non-performance or failure in performance resulting from acts or occurrences beyond its reasonable control, including, without limitation: fire, lightning, explosion, power surge or failure, flood, typhoon, acts of God, war, revolution, civil commotion or acts of civil or military authorities or public enemies; any law, order, regulation, ordinance or requirement of any government or legal body or any representative of any such government or legal body; or labor unrest, including, without limitation, strikes, slowdowns, picketing or boycotts; inability to secure raw materials, transportation facilities, fuel or energy shortages, or acts or omissions of other common carriers.

FORCE MAJEURE
With respect to products or services offered for sale by SMART Paywall, prices are posted on the website before you place an order. We do not charge you until after your order has been confirmed by our payment gateway/s. SMART reserves the right to change the prices of products or services offered for sale.
The List Price shall be inclusive of Value Added Tax (VAT) and other applicable Philippine taxes. SMART will issue a payment record to the customer for every paid and completed transaction.

THE INFORMATION, MATERIALS, AND FEATURES PROVIDED ON OR THROUGH THE SMART MULTI SIM APP ARE PROVIDED “AS IS” WITHOUT ANY WARRANTIES OF ANY KIND, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT OF INTELLECTUAL PROPERTY. WHILE WE TRY OUR BEST TO PROVIDE THE MOST ACCURATE AND UP TO DATE INFORMATION, SMART DOES NOT WARRANT THE ACCURACY OR COMPLETENESS OF THE INFORMATION, MATERIALS OR SERVICES PROVIDED ON OR THROUGH THE SMART MULTI SIM APP. SOME INFORMATION, MATERIALS, AND FEATURES PROVIDED ON OR THROUGH THE SMART MULTI SIM APP MAY BE OUT OF DATE AND SMART DOES NOT MAKE ANY COMMITMENT OR ASSUME ANY DUTY TO UPDATE SUCH INFORMATION, MATERIALS, OR SERVICES. LIMITATIONS OF LIABILITY
SMART does not assume any responsibility for, and will not be liable for, any damage to, or any viruses that may infect your devices, telecommunication equipment or other property caused by, or arising from, your access to, use of, or use of the SMART Multi SIM App, or your downloading of any information or materials from the SMART Multi SIM App. We do not guarantee continuous, uninterrupted, or secure access to the SMART Multi SIM App or its services and operation of the SMART Multi SIM App may be interfered with by numerous factors outside of our control. IN NO EVENT WILL SMART OR ANY OF ITS OFFICERS, DIRECTORS, BOARD OF TRUSTEES, EMPLOYEES, SPONSORS, SHAREHOLDERS, AGENTS, SUCCESSORS OR ASSIGNS, NOR ANY PARTY INVOLVED IN THE CREATION, PRODUCTION OR TRANSMISSION OF THE SMART MULTI SIM APP, BE LIABLE TO YOU OR ANYONE ELSE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION) ARISING FROM THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF THE SMART MULTI SIM APP, ANY APPLICATIONS LINKED TO THE SMART MULTI SIM APP , OR THE MATERIALS, INFORMATION OR SERVICES CONTAINED ON ANY OR ALL SUCH APPLICATIONS, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LAW AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATIONS OF LIABILITY DO NOT APPLY TO THE EXTENT PROHIBITED BY LAW. IN THE EVENT OF ANY PROBLEM WITH THE SMART MULTI SIM APP FEATURE OR ANY CONTENT, YOU AGREE THAT YOUR SOLE REMEDY IS TO CEASE USING THE SMART MULTI SIM APP.

INDEMNITY
You agree to defend, indemnify and hold SMART free and harmless from any and all liabilities, costs, and expenses, including reasonable attorneys’ fees, related to or in connection with: (a) the use of the SMART Multi SIM App or the Internet or your placement or transmission of any message or information on the SMART Multi SIM App; (b) your violation of any of these Terms and Conditions, including without limitation, your breach of any of the representations and warranties above; (c) your violation of any third-party right, including without limitation any right of privacy, publicity rights or intellectual property rights; and (d) your violation of any law, rule or regulation of the Republic of the Philippines relating to your use of the SMART Multi SIM App.

RELEASE
In the event that you have a dispute with one or more other users of the SMART Multi SIM App, you release SMART (and each of our officers, directors, board of trustees, agents, affiliates, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

APPLICABLE LAWS and VENUE
These Terms and Conditions shall be construed and enforced under the laws of the Republic of the Philippines. The parties hereby consent to and submit to the exclusive jurisdiction of the courts in Makati City, Philippines.

GENERAL
If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be deleted and the remaining provisions shall continue to be enforced. You agree that these Terms and Conditions and all incorporated agreements may be automatically assigned by SMART in our sole discretion. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or other users does not waive our right to act with respect to subsequent or similar breaches. These Terms and Conditions set forth the entire understanding and agreement between us with respect to the subject matter hereof. Sections 15 (Limitations of Liability), 16 (Indemnity), and 17 (Release) shall survive any termination or expiration of these Terms and Conditions, your access to the SMART Multi SIM App or use of the features of the SMART Multi SIM App.

ENTIRE AGREEMENT
These Terms and Conditions are the entire agreement between you and SMART and supersede any prior understandings or agreements (written or oral). If you do not agree to these Terms and Conditions, please do not continue accessing the SMART Multi SIM App.

INTELLECTUAL PROPERTY NOTICE
SMART is the owner and manager of the SMART Multi SIM App and the owner/ authorized licensee of all copyright, trademarks, design rights, content, graphics, text selections, or any other intellectual property rights used in the SMART Multi SIM App. All rights are reserved.
