Smart Communications, Inc. (“SMART”) respects your fundamental right to privacy and we
commit to take great care in safeguarding your personal data. In compliance with the Data
Privacy Act, we share with you the principles that govern how your personal data will be
collected and processed as you transact in the SMART Online Store (the
“Store”).
Why we collect and process your personal data
- We collect and process your personal data to perform our obligations under contract with you when you purchase physical and digital goods through the Store.
The SMART Online Store enables you to purchase both physical goods (such as prepaid devices and load cards) and digital goods (such as electronic prepaid airtime load and other prepaid service add-ons) from SMART. Depending on the item that you purchase, Personal Information will be collected from you when you checkout as a guest:
- When you purchase Physical Goods, the following Personal Information will be collected so that we may facilitate the delivery of your purchased item/s to your preferred delivery address:
- Name
- Delivery Address
- Mobile Number
- Email Address
- Landline Number (optional)
- Name of Authorized Representative (optional; necessary only if you would like to assign someone to claim your item/s on your behalf upon delivery)
- When you purchase Digital Goods, the following Personal Information will be collected so that we may facilitate the provisioning of your electronic airtime load or service add-on to your prepaid account:
- Mobile Number
- Email Address (where we will send the receipt of your purchase)
Your Personal Information will be retained in our records for thirty (30) days after the transaction date.
We would like to let you know that we may send you information about the latest SMART Online Store promos and offers products and services through SMS based on your consent. You may adjust your consent preferences by visiting smart.com.ph/privacy.
We have enabled a variety of payment methods for your convenience:
- Credit and Debit Card straight payments via Paymaya Philippines Inc. (“PayMaya”) or iPay88 Philippines Inc. (“iPay88”);
- Credit Card installment payments via Metropolitan Bank & Trust Company (“Metrobank”);
- GCash and GrabPay via Dragonpay Corporation (“Dragonpay”);
- Online Banking via Dragonpay;
- Over-the-Counter via Dragonpay; and
- Cash on Delivery (facilitated through SMART's third party courier).
Depending on the payment method you select, you will be redirected to the corresponding payment gateway owned and operated by Maya, iPay88, Metrobank, or Dragonpay, where you may be asked to submit additional information such as your credit/debit card details or your account number. Any information that you submit through any of these payment gateways is governed by the terms of use and privacy policy of Maya, iPay88, Metrobank, or Dragonpay, as well as the issuing bank of your credit/debit card, depending on the payment method that you select.
We receive payment reports from Maya, iPay88, Metrobank, and Dragonpay, which we use to validate the payments you make through their respective payment gateways. These reports will include information about your transactions such as your masked Credit Card Number, Cardholder Name, Cardholder Email Address, Bank Country, Bank Name, Country, Region, and City.
- We collect and process your personal data based on our legitimate interest to create and offer better products and services for you, except when your fundamental rights and freedoms override our interests.
We may collect information about how you use the Store (i.e., which products are commonly viewed, which sections of the Store are the most popular, how much time is spent prior to making a purchase, and other similar website usage information) to understand how we may be able to continue improving user experience and analyze the Store’s performance. This information is not analyzed or profiled in such a way that identifies you as an individual.
When you purchase goods, you may automatically qualify for special Online Store-exclusive promotions to win prizes such as vouchers. The mechanics of these promotions will be published for your information in the Store.
- With your express consent, we may process the personal data we collect about you as you make purchases through the Store, to send you direct marketing.
If you are a SMART subscriber and have provided your consent to receive marketing and promotions from us via [link to consent management portal], the marketing messages you receive via SMS and email may include promos and offers exclusively available via the SMART Online Store.
Why your personal data is shared
We have engaged the services of Amdocs Philippines Inc. for the development, operations and maintenance of the Store, as well as the services of Google Analytics for the use of their web analytics services. We have also engaged the logistics services of Wide Wide World Express Corporation for the delivery of your purchases to your delivery address.
When your personal data is shared, we ensure that it is done on a confidential basis, through
secure channels, and in compliance with applicable privacy laws and regulations. Only personnel
with a need-to-know will have access to your personal data.
How your personal data is protected
The integrity, confidentiality, and security of your personal data is important to us. This is why
we strictly enforce this Privacy Notice within SMART and have implemented technical,
organizational, and physical security measures that are designed to protect your information
from unauthorized or fraudulent access, alteration, disclosure, misuse, and other unlawful
activities. We also require our service providers to implement the same measures. Your personal
data is also protected from other natural and human dangers.
When you checkout as a guest, your Personal Information will be retained in our records for thirty (30) days after the transaction date.
Your rights and choices
The Data Privacy Act gives you certain rights to your personal data. Subject to exceptions under
the law, you are entitled to request:

Access to the personal data we process about you;

Rectification of your personal data if it is found to be outdated, inaccurate, or incomplete;

Erasure of your personal data in cases where it is no longer needed to achieve the legitimate purpose of its processing;

Restriction of processing of your personal data in limited circumstances;

Portability of your personal data so that you may receive a copy thereof or that we transmit the same to another company on your behalf.
Depending on the circumstances, such as when we process your personal data based on your consent, you may also have the right to object to the processing thereof. If you believe that your data privacy rights have been violated by the use of the Store, we encourage you to contact SMART’s Data Privacy Officer to seek resolution of your complaint. You also have the right to go directly to the National Privacy Commission or to make a claim against SMART before a competent court.

From time to time, we may update this policy to respond to the changes in applicable laws, regulatory requirements, technologies, protocols, industry best practices and business purposes.
