TERMS AND CONDITIONS : (SMART BRO GAME ON! with LEVEL UP! PROMO)
The provision for the Smart Bro Game On! with Level Up! Promo (herein referred to as “Game On Promo”) wherein Smart Broadband, Inc. (herein referred to as “SBI”), together with Level Up! Incorporated (“Level Up”) will provide P250 game credits per month in the subscriber’s Level Up or Net Games e-wallet (herein referred to as “Game On”) at the promo rate of P200/month (VAT-in) for six (6) months for the Promo Period stated herein, shall be governed by the following Terms and Conditions. The terms and conditions (including any amendment) governing the Game On Promo will be available at the website www.smart.com.ph/smartbro.
1. The Game On Promo will run from November 22, 2006 to January 31, 2007 (the “Promo Period”). Applications received during this period, if approved, will be provided with Game On service at the promo rate of P200/month (VAT-in) for six (6) months (the “Special Price Period”), from date of Game On account approval.
2. The promo price of Two Hundred Pesos (P200) VAT-in will be available for six (6) continuous billing months only.
3. If the application is approved, the P200/month (VAT-in) promo rate will be included beginning the subscriber’s next billing cycle, reflected in the bill pertaining to said billing cycle and shall continue to be billed at P200 (VAT-in) within the Special Price Period.
4. Only active Smart Bro Plan 999 subscribers and Smart Bro Computer Stations in good credit standing can avail of the Game On Promo. Smart Bro Plan 988 and Plan 788 subscribers need to upgrade to Plan 999 to avail of the Game On Promo.
5. SBI offers the Game On Promo to its subscribers through a subscription form enclosed in the monthly billing statement mailer package, the Smart Communications, Inc. (“Smart”) Wireless Centers, or through the Smart Bro website: www.smart.com.ph/smartbro
6. It is the sole responsibility of the subscriber to forward his accomplished application form to SBI either through the Smart Wireless Center or through Smart Customer Care via email or fax.
7. SBI shall have the option to approve or disapprove Game On Promo applications based on the subscriber’s credit standing.
8. Subscriber will initially choose if the P250 game credits will be loaded into a Level Up or Net Games wallet.
9. Two (2) days after the application for Game On is approved, subscriber should activate and redeem his Level Up or NetGames wallet account by visiting the Game On! Promo Redemption page at www.levelupgames.ph/smartbro/ and entering his Smart Bro Account Number, Service Reference Number and MyLevelUp or Netgames Wallet Username. Subscriber is encouraged to activate and redeem his Level Up or NetGames wallet account immediately two days after his application approval for him to optimize usage of his game credits.
10. Discontinuance of the subscriber’s Smart Bro subscription, either through request for disconnection, payment delinquency, or for any reason whatsoever, will also result to the immediate termination of his Game On subscription, so that he will no longer receive succeeding monthly game credits.
11. Any delinquency in the payment of the subscriber’s Game On account shall result to a disconnection of both his Smart Bro account and his Game On account.
12. In case of disconnection of the Smart Bro account as a result of payment delinquency, subscriber will have to pay all outstanding balances in his Smart Bro and/or Game On account(s) to have his Smart Bro account reactivated. Clearing only either his Smart Bro or Game On outstanding balances will not activate either his Smart Bro or his Game On account.
13. Smart Bro subscribers can only have one (1) Game On subscription, i.e. one (1) Level Up or Net Games e-wallet per Smart Bro account only. To preserve the security of the subscriber’s Game On account, multiple redemptions are not allowed. Subscriber cannot share his username and password to others.
14. Upon application, subscriber understands that his Game On subscription will automatically continue after the first month and P250 credits will automatically be loaded in his wallet every designated loading cut-off date, unless he informs SBI through the Smart Wireless Center or Smart Customer Care Hotline, of his intent to have the service discontinued, at least fifteen (15) days prior to his billing cut-off date.
15. Monthly loading of credits after the initial loading will be based on the subscriber’s Smart Bro billing cut-off date:

16. Game credits are valid for sixty (60) days from date of loading and will expire if not used within the said validity period.
17. Subscriber will be billed at the rate of Two Hundred Fifty Pesos (P250) VAT-in per month for the succeeding months after the Special Price Period, subject to any change in rate, as may be mandated by SBI.

19. Use of Game On shall likewise be governed by the Terms and Conditions of Level Up found in the following website: www.levelupgames.ph. In case of conflict between the Terms and Conditions of Level Up and these Game On Promo Terms and Conditions, the latter shall prevail.
20. This Game On Promo is subject to the agreement between SBI and Level Up. SBI reserves the right to end the Game On Promo and terminate the Game On service at any time even prior to the end of the Promo Period or the Special Price Period upon the termination of said agreement, for any reason whatsoever.
21. By applying for the Game On Promo, the subscriber agrees to these Terms and Conditions.
